37.02.010 Crimes Involving "Domestic Violence."

(a) Domestic Assault is any act committed against a spouse or intimate partner, or against a child of or in the care of the person committing the domestic assault and shall be punished as enumerated in section 37.0300. Such domestic assaults include but are not limited to the crimes defined in the following:

(1) Homicide Offenses, as defined in Title 26, Chapter 26.10 of the Turtle Mountain Tribal Code;

(2) Sexual Offenses, as defined in Title 26, Chapter 26.12 of the Turtle Mountain Tribal Code;

(3) Assault Offenses (Threat of Bodily Harm, Simple Assault, Assault, Aggravated Assault, Assault Resulting in Serious Bodily Injury, Assault Resulting in Serious Bodily Injury with a Dangerous Weapon, Destructive Device, or Firearm, and Threat of Assault with a Dangerous Weapon, Destructive Device, or Firearm), as defined in Title 26, Chapter 26.13, Section 26.13.060, Section 26.13.070, Section 26.13.075, Section 26.13.080, Section 26.13.090, Section 26.13.100, Section 26.13.110 of the Turtle Mountain Tribal Code; and or

(4) Kidnapping and abduction, as defined in Title 26, Chapter 26.13, Section 26.13.020 and Section 26.13.040 of the Turtle Mountain Tribal Code
